Please read the following to learn more about our privacy policy ("Privacy Policy"). This Privacy Policy applies to the use of the Site (as defined below). Persons using the Site are individually and collectively referred to as "you", and Pacific Living Properties, Inc. and its subsidiaries and affiliates (including the individuals and entities who own the properties managed by PLP) are referred to as, "PLP", "we", "us" and "our".
The PLP website is located at www.pacificliving.com (the "Site"). PLP is committed to implementing policies and procedures designed to protect your privacy and security, in addition to providing you with the best possible online experience. To that end, we want you to understand what kinds of information we gather about you, how this information is used and safeguarded, and how you can control its use.
In conjunction with this Privacy Policy, the use of the Site is also subject to our General Terms and Conditions of Use Agreement ("Terms of Use"). The Terms of Use sets forth a complete understanding of the rules governing our Site.
Information You Give Us
Information collected from you will vary, depending on how you use the Site and what information you may choose to provide to us (whether through e-mail, online applications, online service requests or otherwise). It is possible to browse most sections of the Site anonymously without submitting any personally identifiable information. Personally identifiable information ("Personal Information") means individually identifiable information about you that we, or third-party service providers with whom we have contracted, collect online, including but not limited to, your full name, a user name and password, e-mail address, phone number, driver license, information about your prior rental activities, physical address, or, for certain products or services, pay stub information, credit information, your social security number or financial information. Personal Information is collected only when you submit such information through the Site or authorize a third party, such as a Social Media site, to do so on your behalf. We do not utilize any other means to collect Personal Information. If you choose to take advantage of some of our products and/or services, or to access certain of our tools or Site functionality, you may be asked to provide Personal Information. You can choose not to provide us with Personal Information, but then you may not be able to fully take advantage of certain features of our Site and we may not be able to provide you with certain requested information, products and/or services. Notwithstanding the foregoing, PLP does not require the disclosure of Personal Information through the Site prior to providing its services to customers, nor does it charge different prices to those who choose not to provide such Personal Information through the Site. Please note that we contract with third party service providers to provide services to us which are used on the Site, including, without limitation, our online rental application service, our referral network, renter insurance and our resident portal service (including, without limitation, online rent payment and online service request portal).
Automatic Collection of Information
Like many web sites on the Internet, we may automatically track certain information about you as you visit and use our Site to help us to better understand how the Site is used and how we can enhance your overall experience on the Site. This information may include your computer's Internet Protocol address, the URLs and Site pages you have visited, the number of times you visit each Site page, what downloads and/or search queries you have made, how long you spent on particular sections of the Site and on the Site generally, and your browser type. This automatically gathered data includes information provided through the use of "cookies" (which is described in more detail below).
Information from Cookies
Cookies are small files that we may send to and store on your computer so that we can recognize it as a unique machine the next time you visit the Site. The Site will prompt you for your permission prior to the use of any cookie which are not strictly necessary. You are always free to decline any cookies we use if your browser permits. If you use Facebook, Twitter, Google+ or other social networking sites (“Social Media”) to either log in or to otherwise associate with the Site, we will collect and store your Social Media user ID and will also extract any information from such Social media that is needed to either complete your account registration, to connect you with other users through such Social Media or to permit you to use such Social Media to enable single sign-on functionality.
Personal Information
We may share the Personal Information we collect from you only with your consent or under the following circumstances:
User-Requested Services and Information. Certain products or services on our Site may seek Personal Information from you, which may be used in the following ways:
For products and services provided by the Site or PLP, the information you submit is used by us to provide the information, product or service you've requested. We may also share this information with others, but only to the extent necessary to fulfill your request or to facilitate your use of their services. We do not sell your Personal Information to third parties. In addition, we may use any registration information that you submit for making decisions regarding leasing apartments to you. We may use or contract with other companies and individuals to perform supporting functions for the various tools, functionality, products and services offered through our Site on our behalf. These service providers will have their own privacy policy with respect to how such information is used. These services shall include, but are not limited to, online applications, applicant screening, credit reporting and related services.
For products and services offered to you jointly by us and a third party, your Personal Information may be shared with or independently gathered by the third party (such as when you complete an online application and upload Personal Information). In these situations, PLP will only use your Personal Information as outlined in this Privacy Policy, but the third party may use the information in different ways. Please be aware that each company we do business with has its own policies regarding the use and protection of your information that may differ from those outlined in this Privacy Policy.
To the extent you provide us with Personal Information, such Personal Information will be made available to our employees, agents, owners and affiliates. To the extent there are more than one resident’s in the apartment unit you lease or intend to lease from us, the information in your file (whether a physical copy or an electronic copy stored in one or more portal systems associated with the Site), all of the resident’s and guarantors related to that apartment unit may have access to your Personal Information.
User-Initiated Communication. From time to time, portions of the Site may enable you to send e-mails to us, and to complete and send online applications. All such e-mails/postings and communications become our property. Whenever you choose to initiate these kinds of communication with us, or anyone else, you may be contacted in return. Also, remember that communications to us are open to the public, and therefore, your communications can be seen by anyone and are not protected by us or any other entity, unless we choose to maintain such communications as confidential material. Please use your own discretion when deciding what to communicate. We reserve the right, in our sole discretion, to edit or delete inappropriate communications. This reservation of rights shall not under any circumstances obligate us to conduct such edits or deletions, nor shall it cause us to be liable for any such edits or deletions.
Referrals. If you participate in any referral service we may offer we may use the information you submit to determine which of our marketing partners and service professionals may be able to serve your needs. We may then forward your information, which may include Personal Information, contained on our sign-up form to certain third-parties, who may then contact you.
Protection of rights
We will release Personal Information if we believe that such action is appropriate to: (1) comply with legal process, (2) enforce the Terms of Use Agreement for the Site, or (3) identify, contact or bring legal action against persons or entities who are or we perceive will cause injury to us or a third party, or (4) otherwise protect the rights, property or personal safety of PLP, its employees, Site users or others.
General Data Protection Regulation (GDPR).
PLP’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.
PLP may process your Personal Data because:
- We need to perform a contract with you
- You have given us permission to do so
- The processing is in our legitimate interests and it is not overridden by your rights
- For payment processing purposes
- To comply with the law
If you are a resident of the European Economic Area (EEA), you have certain data protection rights. PLP aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your Personal Data, even if you are not a resident of the EEA. For the purposes of the GDPR, “Data Controller” means the natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal information are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your Personal Data. “Data Processor” (or Service Provider) means any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.

Under Chapter 3 of the GDPR, you have certain rights, including:
- The right to be informed; This means anyone processing your personal data must make clear what they are processing, why, and who else the data may be passed to.

- The right to rectification; the right to have your data corrected or amended if what is held is incorrect in some way.
- The right to erasure; under certain circumstances you can ask for your personal data to be deleted. This is also called ‘the Right to be Forgotten’. This would apply if the personal data is no longer required for the purposes it was collected for, or your consent for the processing of that data has been withdrawn, or the personal data has been unlawfully processed.
- The right to restrict processing; this gives you the right to ask for a temporary halt to processing of personal data, such as in the case where a dispute or legal case has to be concluded, or the data is being corrected.
- The right to data portability; a you have the right to ask for any data supplied directly to the Data Controller by him or her, to be provided in a structured, commonly used, and machine-readable format.
- The right to object; you have the right to object to further processing of their data which is inconsistent with the primary purpose for which it was collected, including profiling, automation, and direct marketing.
Rights in relation to automated decision making and profiling; Data Subjects have the right not to be subject to a decision based solely on automated processing.

California Do Not Track Signals
What is a DNT Signal?
Currently, various internet browsers offer a DNT option that relies on a technology known as a DNT header that sends a signal to websites visiting by the browser user about the user’s DNT preferences. You can usually access your browser’s DNT option in your browser’s preferences.
How to We Respond?
PLP does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. Accordingly, a DNT standard has not been adopted to this day, and therefore PLP does not utilize DNT signals.
Asset transfers
We continue to develop our business and in doing so might choose to buy or sell other businesses or assets. Personal Information is generally one of the transferred assets acquired or transferred in such transactions and such transfers will likely occur in the event we sell all or part of our business, including an individual property.
Registration Information
The Personal Information you provide when you become a registered user, you complete an online application (including uploading documents and other information), you utilize our Site for customer service aspects (including, without limitation, paying your invoice or making service requests) or when you generally use the Site, is used primarily to help us enhance your online experience, increase the convenience of accessing new tools, products and services, and, if applicable, provide the products and/or services you request. Your e-mail address serves as a unique identifier in our record system, and together with your password is designed to prevent unauthorized access to any information you choose to store on the Site. The data you give us about your personal preferences and demographics may be used to help us offer content, advertisements, products, and services that we believe will be of interest to you. In addition, we may share this information, in aggregate form, with our current and potential advertisers so that they can present advertisements more effectively. Any such information shared will be aggregated and anonymized. No Personal Information will be shared except for as described below.
Unless you specify that you'd prefer not to hear from us, we may use the e-mail address you provide at the time of registration or application or as set forth in your lease file to contact you for promotional or other purposes. You may have these communications terminated at any time by opting out through your member profile on the applicable Site, or by clicking on any "unsubscribe" link contained in a promotional e-mail.
We may provide you with information to keep you abreast of the services on the Site or third-party products and services. Personal Information such as your personal financial information will not be shared with third parties except to complete a transaction, provide you with services, or as provided in the paragraphs above. To the extent such information is necessary to offer such services it will be posted on the Site.
Your Choices. You may update or modify certain settings and the Personal Information you provide to us through your registered account. To protect your privacy and security, we require your username and password in order to verify your identity before granting you account access or making changes. Automatically Gathered Information
Information that is automatically gathered, including through the use of cookies, may be shared by us in aggregate form with other third parties, including listing providers, and advertisers, so that we may better understand how the Site is used and to enhance your overall experience on the Site. When such data is aggregated, all Personal Information is eliminated.
Children's Privacy
Our Site is a general audience web site. If you are under the age of 18 you should not register, apply for an apartment online or provide information on our Site. We do not collect Personal Information from any person we actually know is a child under the age of 18.
Protection
Whenever Personal Information about you is stored on our computers, that information is password-protected from unauthorized access or use. Such Personal Information shall also be stored and/or utilized by other third-party service providers for screening and related services. In addition, this information is kept on servers that are located behind a firewall. Since your financial information and certain other Personal Information (i.e., your social security number) are especially sensitive, we will attempt to take special care to keep it secure. We will only electronically transmit or ask for this information over secure Internet connections using SSL (Secure Sockets Layer) encryption, the currently accepted standard for online security, and security keys. In addition, we require password authentication from any third parties you have authorized to receive this information. Finally, to the extent that we may ask for your social security number, credit card number or financial information, these will be stored on secure designated servers where access is limited to individuals in departments charged with using such information only in connection with processing your orders for products and services purchased and by the required third-party service providers; provided, however, that those orders processed by our partners, marketing allies and service providers that provide the service or product requested may store such information on their servers which are governed by such third party's privacy policy and security procedures. We reserve the right to transmit your Personal Information to third-parties for purposes of checking your credit, screening your application and other related services. Of course, we appreciate your help in safeguarding the integrity of your own and others' privacy. We hope you'll use common sense whenever you disclose Personal Information over the Internet. Just as importantly, we encourage you to let us know immediately if you suspect that the information you share with us is being used in any way contrary to this Privacy Policy. Finally, unfortunately no data transmission over the Internet or the storage of information on servers can be guaranteed to be 100% secure and while we strive to protect your personal information, as described herein, we cannot guarantee or warrant its complete security.

Be aware that our Site links to other websites that may collect personally identifiable information about you. This Privacy Policy only applies to the Site, and we are not responsible for the privacy practices or the content for any linked websites, including, without limitation, third-party service providers. You should refer to the privacy policies and statements of other websites or contact the respective webmasters of those websites to obtain information regarding their information collection, use and disclosure policies. Effective Date and Modifications
This Privacy Policy is effective as of the date first written above and may be updated and modified from time to time by us in our sole discretion. If we choose to update or modify this Privacy Policy, such updated or modified policy shall become effective five (5) business days after its posting on the Site. Furthermore, the new policy shall be communicated via email to registered users before it becomes effective. Accordingly, we encourage you to periodically review this Privacy Policy and the Site in order to keep apprised of our current privacy practices. If you do not agree to any provision of this Privacy Policy, or any update or modification thereto, please do not use the Site.
